New regulations on goods and service information on e-commerce websites

On September 25, 2021, the Government issued Decree No.85/2021/ND-CP amending and supplementing a number of articles of Decree No.52/2013/ND-CP dated May 16, 2013, on the e-commerce trading floor. As for regulations on information on goods and services introduced on sales e-commerce websites, in this Decree, a number of new regulations have been added, including:

  1. Sellers must provide information about their goods/services introduced on websites to customers to accurately determine properties of goods/services and avoid misunderstanding when making decisions on the conclusion of contracts;
  2. Information about goods published on websites must include required information shown on labels of goods as prescribed by the Law on labeling of goods (except distinguishing characteristics of each product such as date of manufacture, expiry date, lot number, chassis number or engine number);
  3. For sellers of goods and services, conducting business in lines of business on the list of conditional business lines, investment and business conditions must be satisfied; must announce the number, date of issue and place of issue of the License, Certificate of eligibility, written certification, or other forms of documents in accordance with the law on business conditions of that line of business.

Compared with Decree No. 52/2013/ND-CP, Decree No. 85/2021/ND-CP has added conditions (2) and (3) for information about goods and services introduced on the website. Therefore, traders, organizations, and individuals with e-commerce activities need to do the following:

  1. For traders, organizations, and individuals whose e-commerce activities have been notified and registered by the Ministry of Industry and Trade according to the provisions of Decree No. 52/2013/ND-CP, within 180 days from the effective date of this Decree (from January 1, 2022), the notice must be amended and supplemented, and the registration must be made in accordance with the provisions of this Decree.
  2. For traders, organizations, and individuals engaged in e-commerce activities that have submitted notification or registration dossiers but have not been certified by the Ministry of Industry and Trade before the effective date of this Decree (from January 1, 2022), notification, and registration shall be made according to the provisions of this Decree.

This Decree takes effect from January 1, 2022.
